Deuel County Sheriff Cory Borg Helps Develop South Dakota Brady-Giglio Disclosure Policy

Northeast Radio SD News – Deuel County, SD - South Dakota Attorney General Marty Jackley has released a recommended model policy designed to help prosecutors and law enforcement agencies meet constitutional disclosure requirements in criminal cases. The guidance was developed by a statewide task force Jackley created in 2025, which included Deuel County Sheriff Cory Borg.

Jackley said the recommended policy is intended to strengthen transparency and provide a consistent framework for handling evidence disclosures required under the U.S. Supreme Court’s Brady v. Maryland and Giglio v. United States decisions. Those rulings require prosecutors to disclose evidence favorable to defendants, including information that may affect the credibility of government witnesses such as law enforcement officers.

“This recommended model policy furthers government transparency,” Jackley said. “It provides South Dakota prosecutors and law enforcement agencies with a consistent framework for addressing Constitutional disclosure obligations. I thank the task force members for developing practical guidance that promotes fairness, consistency, and confidence in the criminal justice system.”

The task force reviewed existing Brady/Giglio requirements and created procedures for identifying potential disclosure information, evaluating credibility‑related matters involving recurring government witnesses, and making case‑specific disclosure decisions. The guidance is advisory only and does not create a mandatory statewide process or limit the independent judgment of State’s Attorneys.

The Attorney General’s Office said the recommended policy is available to prosecutors and agencies statewide as a resource for improving consistency in criminal case disclosures.
