State Commission Considers Action Against 20 Telecommunications Companies for Delinquent Tax Payments

Northeast Radio SD News – South Dakota - A state regulatory commission is moving to address the failure of 20 telecommunications companies to pay their required gross receipts tax on time. The commission reviewed a proposal to issue an Order to Show Cause, which could result in fines, suspension, or revocation of the companies' Certificates of Authority.
During the session, the commission first received a Status Report on Consumer Utility Inquiries from Consumer Affairs representative Deb Gregg.
The meeting then shifted focus to a significant financial matter. Finance Manager Cindy Kemnitz presented information regarding the failure of numerous telecommunications companies to comply with state law requiring the timely payment of gross receipts tax, specifically citing SDCL 49-1A.
According to the report, the following companies have failed to meet their financial obligations:

· Cliq Communications LLC dba Cliq Mobile
· Comlink Total Solutions Corp.
· Go Technology Management, LLC
· Hello Mobile Telecom, LLC
· Lux Mobile USA, Inc.
· Mobile 13, Inc.
· Native Wireless, LLC dba Free Conferencing Corporation (CarrierX, LLC)
· NetworkIP LLC dba Elite Telecom
· Pareteum Corporation
· Phreeli Company
· Power Mobile LLC
· Prepaid Wireless Wholesale, LLC
· Q Link Wireless LLC
· Ready Wireless LLC dba Affinity Cellular and Club Cellular
· RSCU Mobile LLC
· Splash Cellular LLC
· Volt Mobile INC
· Wide Voice, LLC
· Working Assets Funding Service Inc. dba Credo Long Distance
· Wrazzle, Inc.
The commission is currently considering a motion to issue an Order to Show Cause to each of the listed companies. This action would require the companies to justify why the commission should not fine them, or suspend or revoke their Certificates of Authority, for their failure to pay the requisite gross receipts tax. The decision on whether to proceed with the Show Cause order was placed before the commission.
