Deuel County Sheriff Appointed to State Commission on Fair Trial Compliance

Northeast Radio SD News – South Dakota - South Dakota Attorney General Marty Jackley has formed a new commission tasked with developing uniform standards for law enforcement agencies across the state regarding the disclosure of evidence in criminal cases, a constitutional requirement set forth by the U.S. Supreme Court.
Among the key law enforcement officials appointed to this crucial task force is Sheriff Cory Borg of Deuel County, representing local police agencies in the effort to ensure consistent compliance across South Dakota.
The commission’s creation is a direct response to the requirements outlined in the Supreme Court case Giglio v. United States. The ruling mandates that prosecutors must disclose to the defense any evidence that could potentially undermine the credibility of government witnesses—including law enforcement officers—to ensure the defendant receives a fair trial. Failure to disclose this evidence can result in a new trial.
Attorney General Jackley emphasized that adherence to the Giglio ruling is fundamental to the state’s judicial integrity. "Giglio compliance isn’t just a legal requirement; it’s the foundation of the State’s credibility in the courtroom," stated Jackley. "South Dakota law enforcement officers have earned the public’s trust, and transparency through this Commission’s efforts only builds upon this trust."
The commission will review current practices within South Dakota agencies and subsequently recommend a consistent standard that local and state law enforcement agencies and prosecutors may adopt at their discretion.
