McLaughlin Man Sentenced to Federal Prison for Assault Resulting in Serious Bodily Injury

Northeast Radio SD News – South Dakota - A McLaughlin, South Dakota, man, Brady James Claymore, 38, has been sentenced to two years in federal prison after being convicted of Assault Resulting in Serious Bodily Injury. U.S. District Judge Charles B. Kornmann handed down the sentencing on December 4, 2025.


Following his release from prison, Claymore will serve three years of supervised release. He was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund. Claymore was immediately remanded to the custody of the U.S. Marshals Service.


The charge stemmed from an incident on the evening of December 26, 2024, at Claymore’s mother’s home in McLaughlin, which is located within the Standing Rock Sioux Indian Reservation.


Court documents stated that Claymore was drinking alcohol when his mother accused him. Claymore responded by placing his hands around her neck and squeezing. Claymore let go after his brother punched him several times in the head, causing Claymore to lose his balance. Both Claymore and his mother then tumbled down a short flight of steps. Claymore’s mother sustained a broken nose and three fractured teeth in the fall.


Claymore was indicted by a federal grand jury in May 2025 and subsequently pleaded guilty to the charge on September 16, 2025.


The case was prosecuted in Federal Court under the federal Major Crimes Act, which mandates that certain violent crimes alleged to have occurred in Indian Country be charged at the federal level instead of in State Court. The Bureau of Indian Affairs investigated the case. Assistant U.S. Attorney Carl Thunem prosecuted the case on behalf of the U.S. Attorney’s Office.
