Oregon Man Xavier Riley Cook Indicted on First-Degree Rape Charges in Codington County

Northeast Radio SD News – Watertown, SD - A Redmond, Ore., man faces 11 criminal charges in Codington County, including three counts of first-degree rape, stemming from allegations spanning nearly four years.

Xavier Riley Cook, 30, appeared in the Third Judicial Circuit Court for an initial appearance on Oct. 2, 2026. Defense attorney Teree Nesvold represents Cook, and prosecutor Alison Trauba represents the State of South Dakota.

An arraignment is scheduled for Nov. 18, 2026.

According to court documents, a Codington County Grand Jury issued an indictment on Sept. 3, 2026, officially charging Cook with:

·         Three counts of first-degree rape involving a minor under 13, each a Class C Felony.

·         Four counts of sexual contact with a child under 16, each a Class 3 Felony.

·         Three counts of sexual exploitation of a minor, each a Class 6 Felony.

·         One count of false imprisonment, a Class 1 Misdemeanor.

The indictment alleges that Cook committed the offenses against a minor victim between July 2022 and April 2026. Specifically, several of the charges, including one count of first-degree rape, two counts of sexual contact with a child, and one count of sexual exploitation of a minor, allegedly occurred between July 2022 and July 2023. The remaining seven charges, which include two additional counts of first-degree rape and the false imprisonment count, are alleged to have occurred between July 2025 and April 2026.

A circuit court judge signed an arrest warrant for Cook on Sept. 3, 2026. The court set bond at $250,000 cash or surety. As a condition of his bond, Cook is prohibited from having contact with minors.
