South Dakota Consumers Urged to Claim Compensation in Generic Drug Price-Fixing Settlement

Northeast Radio SD News – South Dakota - South Dakota consumers who purchased certain generic prescription drugs between May 2009 and December 2019 may be eligible for financial compensation following preliminary court approval of a multi-state settlement.


 Attorney General Marty Jackley is encouraging eligible state residents to review the qualifying drug list and submit claims for reimbursement. Settlement Background and Eligibility.


 The distribution plan received preliminary approval from the U.S. District Court for the District of Connecticut. The funds stem from settlements paid by generic drug manufacturers in response to allegations that the companies illegally conspired to inflate prices.


South Dakota is part of a coalition of states and territories that has engaged in antitrust lawsuits against pharmaceutical manufacturers since 2016. To date, announced settlements in the litigation total $96.5 million.

 “I will not allow South Dakota consumers to pay inflated prices for generic drugs,” Attorney General Jackley said. “Generic drug companies cannot be allowed to profit through illegally raised prices. "How to Check Eligibility and File a Claim.” 

 To qualify for compensation, consumers must have purchased an eligible generic drug between May 2009 and December 2019.


Residents can review the full list of generic drugs or access the settlement portal to determine eligibility and submit a claim.
