Kyle Man Sentenced to 46 Months for Involuntary Manslaughter in Fatal DUI Crash

Northeast Radio SD News – South Dakota - U.S. District Judge Camela C. Theeler has sentenced a Kyle, South Dakota, man to nearly four years in federal prison for Involuntary Manslaughter stemming from a fatal drunk driving crash that occurred in May 2024.


Kevin Hunter, 33, was sentenced on December 1, 2025, to 46 months in federal prison, followed by three years of supervised release. He was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund.


A federal grand jury indicted Hunter in July 2024, and he subsequently pleaded guilty on September 2, 2025.


According to preliminary information released by the U.S. Attorney’s Office, the crash took place on May 15, 2024, near Kyle, South Dakota. Hunter was driving his pickup while under the influence of alcohol and traveling in excess of 80 miles per hour when he crossed into the oncoming lane and collided with a van, resulting in the death of a passenger.


Following the collision, Hunter immediately fled the scene instead of seeking assistance or calling 911. He later provided investigators with false information regarding his location that night.


During sentencing, Judge Theeler noted Hunter’s history of previous DUI convictions, stating that the sentence—which was at the top of the Sentencing Guidelines range—was necessary to protect the public.


The case was prosecuted in Federal court under the Major Crimes Act, a federal statute that requires certain violent crimes committed in Indian Country to be handled by the Federal judicial system. The FBI and the Oglala Sioux Tribe Department of Public Safety Criminal Investigations Division conducted the investigation. Assistant U.S. Attorney Anna Lindrooth prosecuted the matter.


Hunter was immediately taken into custody by the U.S. Marshals Service.
