Rounds, Hyde-Smith Introduce 2026 Dismemberment Abortion Ban Act Targeting Second-Trimester Procedures

Northeast Radio SD News – South Dakota - Marking the fourth anniversary of the landmark Dobbs v. Jackson Women’s Health Organization decision that overturned Roe v. Wade, U.S. Senators Mike Rounds (R-S.D.) and Cindy Hyde-Smith (R-Miss.) introduced new legislation today aimed at federally prohibiting a specific second-trimester abortion method.
The Dismemberment Abortion Ban Act of 2026 targets dilation and evacuation (D&E) procedures, which the bill’s sponsors refer to as “dismemberment abortions.” Senator Hyde-Smith currently serves as the chair of the Senate Pro-Life Caucus.
Key Provisions of the Legislation
If passed, the legislation would implement strict new federal standards and criminal penalties for healthcare providers. Key components include:
· Federal Prohibition: Establishes a nationwide ban on D&E procedures, which the bill describes as extracting an unborn child piece by piece using surgical instruments.
· Criminal Penalties: Physicians or healthcare providers found guilty of knowingly performing the procedure would face fines and/or imprisonment for up to two years.
· House Companion Bill: Companion legislation has concurrently been introduced in the House of Representatives by Representative Kat Cammack (R-Fla.).
Lawmakers Advocate for Federal Standards
The bill’s sponsors argue the legislation is a necessary step to protect fetal life and hold medical practitioners accountable under a unified federal standard.
“Every life is a precious gift from God and should be treated with dignity,” Senator Rounds stated. “Dismemberment abortions are among the most brutal methods of abortion, accounting for around 80% of second-trimester abortions. Our legislation would make performing a dismemberment abortion a criminal offense.”
Senator Hyde-Smith echoed these sentiments, emphasizing the developmental stage of the fetus during these procedures. “Every pre-born child is precious, and it’s appalling that any physician trained to save lives would dismember a child in the womb. The fact that this horrifying procedure is still being done to babies who can feel pain in the womb is why we need to enact the Dismemberment Abortion Ban Act.”
In the House, Rep. Cammack positioned the bill as a measure to close legal loopholes.
“Under our current system, abortion procedures exist in a legal gray area with no federal standards and no accountability,” Cammack said. “This bill sets a clear federal standard that holds providers accountable, protects the dignity of all life, and ensures women are protected, not prosecuted.”
Backing from Pro-Life Organizations
The Dismemberment Abortion Ban Act has garnered sweeping endorsement from a coalition of prominent pro-life and religious organizations, including South Dakota Right to Life, the National Pro-Life Alliance, National Right to Life, the Ethics and Religious Liberty Commission, Susan B. Anthony Pro-Life America, and Live Action.
Advocates highlighted the legislation as a vital continuation of the pro-life movement’s goals in a post-Roe legal landscape.
· Susan B. Anthony Pro-Life America: Vice President of Government Affairs Hon. Marilyn Musgrave noted that the procedure takes the lives of 60,000 to 70,000 babies every year. “As we continue onward in a post-Roe America, we look forward to continuing to work with members of Congress to pass legislation that protects unborn children and their mothers from the horror of abortion.”
· National Right to Life: President Carol Tobias praised the reintroduction of the bill, stating, “No child should be subjected to being torn apart piece by piece before birth. This bill affirms the fundamental principle that every human life has inherent dignity and worth.”
· South Dakota Right to Life: Executive Director Jenn Lee called the legislation “an important and compassionate step toward protecting babies from violence and affirming our nation’s dedication to life.”
