On August 17, 2026, U.S. Bankruptcy Judge Shon Hastings signed a final order authorizing Chapter 7 Trustee Erik Ahlgren to convey the property at 315 E. Kemp Avenue to Archer Land Co., LLC. The principal office is in Lake Norden, SD, and the registered agent is Kelan Bludorn.
A Disputed Amendment and Deadline Extension
The transaction unraveled following a motion filed by Trustee Ahlgren on July 7, 2026. Ahlgren sought to amend the court’s original June 4 sale order to explicitly enumerate 16 separate mortgages, mechanic’s liens, and court claims to satisfy title insurance requirements under South Dakota law.
Build, LLC—the entity owned by Craig that originally won the bankruptcy auction with an $11.265 million bid—objected to the motion and initiated an adversary lawsuit against the trustee. Primary secured lender Red River State Bank pushed back against the objection, arguing that Craig was attempting to stall the closing process and prejudice creditors.
To resolve the dispute, Ahlgren and Build, LLC negotiated a court-approved stipulation in late July. The agreement granted Build, LLC a final extension until 11:59 p.m. on Friday, August 14, 2026, to deliver the purchase price. However, the agreement carried strict default terms: if Build failed to close, its $1,126,500.00 earnest deposit would be turned over to the bankruptcy estate, Craig’s lawsuit would be dismissed with prejudice, and the property would automatically revert to backup buyer Archer Land Co.
Deadline Passes and Sale Finalized to Backup Buyer
On August 17, Trustee Ahlgren filed a verified certification confirming that Build, LLC failed to close on the purchase before the August 14 deadline and that the failure was not attributable to the trustee. Judge Hastings immediately issued an order executing the stipulation’s terms:

The collapse of Craig’s $11.265 million purchase drastically changes the financial recovery for creditors involved in the 18-month bankruptcy proceeding. While the estate retains the $1.126 million earnest money deposit, the drop in actual sale proceeds to $6.1 million creates a severe shortfall.
Under the approved distribution structure, gross proceeds must first cover unpaid real estate taxes, municipal assessments, closing costs, trustee surcharges, and broker commissions.
The remaining funds flow entirely to Red River State Bank toward its $10.49 million mortgage cap. Because the total recovery falls well short of Red River State Bank’s debt, secondary mortgage holder Watertown Development Company and over a dozen local contractors holding mechanic’s liens are unlikely to receive payouts from the real estate sale.
